Dick Pound has warned Washington against overreaching in its probe into a doping case involving 23 Chinese swimmers

The US could be disqualified from hosting the 2028 Summer and 2034 Winter Olympics if it oversteps legal boundaries while investigating Chinese swimmers over doping suspicions, Dick Pound, the former president of the World Anti-Doping Agency (WADA), has said.

In April, the New York Times and German broadcaster ARD published a report alleging that 23 Chinese swimmers had tested positive for banned drugs prior to the Tokyo Olympics in 2021, but were nevertheless allowed to compete. WADA later confirmed the claim but said it had accepted the findings of the Chinese authorities that the swimmers were “inadvertently exposed to the substance through contamination.”

The statement triggered outrage in Washington. The US Anti-Doping Agency (USADA) accused WADA of “having swept these positives under carpet” and warned that the agency’s handling of the case could jeopardize the credibility of the Paris Olympics, which begin next week.

Earlier this month, several US outlets reported that the Justice Department launched a criminal investigation into how global sports officials were handling the case of the Chinese swimmers. The US authorities were reportedly operating under the 2020 Rodchenkov Act, which purports to extend American jurisdiction to international sporting events involving American athletes or having financial ties to the US.

In response, WADA said it was “disappointed” by the reports about the probe, adding that they “validate the concerns… about the passage of the Rodchenkov Act” in the US.

Commenting on the apparent US investigation into the controversy regarding the Chinese swimmers, Pound told Reuters on Tuesday that the Rodchenkov Act “is non-compliant with the anti-doping code.”

“My guess is that one of the steps that WADA is going to take at this point is to turn this particular issue over to the compliance review committee,” he added.

Once these proceedings are initiated, Pound continued, the US could be declared non-compliant, meaning that “they could not host the Olympics.” Reuters reported, citing sources, that WADA is indeed considering taking the US to the review committee.

Pound also weighed in on the swimmer controversy, suggesting that US actions on the matter lack any ground. “This was… a domestic China competition, there wasn’t an American within 6,000 miles. Now all of a sudden they’re trying to upgrade this to a Rodchenkov violation.”

The 2028 Summer Olympics is scheduled to take place in Los Angeles. The location for the 2034 Winter Olympics has not been officially confirmed, but the International Olympic Committee has already listed Salt Lake City as a preferred host.
